Woman in Her 30s Faces Jail Time for Fabricating Rape Allegations, Tougher Legal Consequences Imposed

A woman in her thirties has been handed a prison sentence after falsely accusing her biological father, who had funded her overseas education, of rape when he declined her financial request.

According to sources within the legal community, on the 1st of the month, the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, led by Presiding Judge Choi Chi-bong, sentenced a woman known only as A to 10 months in prison. Her charges comprised defamation, business obstruction, and insult.

The individual, A, faced legal proceedings for posting defamatory content about her father, B, on an online platform 11 times between May and June of the previous year. Her posts were titled "I am a victim of familial sexual violence. Please look at this."

These online posts contained untrue statements, claiming, "I have been continuously sexually assaulted by my biological father since I was four," and "My mother also endured domestic and sexual violence," along with "The issue was resolved with 30 million won in damages," and "Severe punishment is necessary."

During this episode, A also revealed B's identity and business details, which reportedly disrupted his business operations.


 


A also faced accusations of posting six times alleging that B remarried a woman, C, with whom he allegedly had an affair.

In February 2021, A initiated a lawsuit against B in the Incheon District Court for damages related to sexual assault but was unable to substantiate any illegal acts.

Throughout her criminal trial, A continued to assert the truthfulness of her statements, but the court rejected her claims, referencing the lawsuit outcome. The court highlighted the absence of specific evidence or circumstances supporting A's claims of habitual sexual assault by B.

Moreover, the court deemed it plausible that A's allegations were misleading, noting that she had received financial assistance from B for her studies abroad and after returning, and filed the rape charges shortly after B denied her request for a significant sum to open a café.


The court stressed, "She disseminated false information about the victims due to her dissatisfaction with being denied financial support. The reputations of the victims have suffered irreparable harm."


Explaining the basis for the sentencing, the court added, "Given the high risk of reoffending, evidenced by her continued similar postings, and the victims' strong demands for severe punishment, these factors were thoroughly considered."
